Supreme Court Upholds Philip Morris Ruling

The Supreme Court is upholding a court ruling that threw out a fraud judgment against Philip Morris USA. The tobacco giants were involved in a class action lawsuit that accused the company of fraud and misrepresentation of their "light" cigarettes, claiming that not only was Philip Morris aware that the light cigarettes were not healthier than regular cigarettes, they also deliberately hid information about the light cigarettes containing a more toxic form of tar. An Illinois Supreme Court threw out the $10.1 billion verdict last year (05), ruling that because the Federal Trade Commission allows companies to describe cigarettes as "light" and "low tar," even if the terms Philip Morris used were found to be false or misleading the company could not actually be held liable under state law. And the Supreme Court has upheld the verdict involving 1.1 million people who bought "light" cigarettes in Illinois.
