Settlement Reached in Medical Malpractice Suit

The family of a man who died of a ruptured aorta has reached a settlement in the medical malpractice lawsuit against the hospital where he died. Diontray Bell, 29 was admitted to the emergency room at Lutheran Hospital (FEB05), complaining of throat pain, stomach ache, shortness of breath and blurred vision. An employee misplaced the X-ray of Bell's weakened heart, leading a radiologist to examine another person's X-ray. Bell was subsequently discharged from hospital and died two days later. A $3.2 million wrongful death and negligence lawsuit was filed against the hospital and the radiologist, Dr. Beth Llewellyn, in Cuyahoga County Common Pleas Court by Bell's wife Tabitha Hawkins. An out-of-court settlement was reached on the day the case was scheduled for trial. Although both parties signed confidentiality agreements, the amount of the settlement will become public when Hawkin's lawyer William Jacobson files documents in probate court.
