Medical Malpractice Case Settled at $1 million

A case that involves a now 5-year-old boy has settled for $1.05 million dollars. The boy’s parents, Darren and Jennifer Bryan, claimed medical malpractice errors at birth left him with physical and developmental problems. In agreeing to the settlement, the defendants, Doctor David Evans and Belvedere Medical Corporation of Carlisle, deny any liability for the child's condition. The Evans felt that steps should have been taken to prevent their son from suffering fetal distress, oxygen deprivation and brain injury during delivery in May 2001. Court documents show the child is mentally retarded, has cerebral palsy and severe childhood epilepsy. Under the agreement, approximately $555,000 of the settlement will be invested in a trust for the boy.
