Man Awarded $280,000 After Motorcycle Accident

A Maui Circuit Court jury has awarded $280,000 in damages to a man injured in a motorcycle accident (02NOV06). Charles Amerio, 38, of Lahaina was severely injured when a Roberts Tours & Transportation Inc. bus backed into his motorcycle, causing him to suffer neck, shoulder, arm and lower back injuries. Amerio's lawyer Krueger accused Roberts and driver Samson Vinuya of negligence, stating that Vinuya had 11 company warnings, including speeding and causing accidents. The suit also accused Roberts of failing to provide a spotter on the bus to make sure the bus' blind spot didn't cause any accidents. Roberts was subsequently fined $280,000 for comparative negligence. Roberts' attorney George Van Buren says, "The jury carefully considered the evidence, the judge was fair and impartial, and we believe the decision was fair."
