Judge Dismisses Wrongful Death Suit

A federal judge in Salt Lake City, Utah has dismissed a lawsuit accusing a sheriff's deputy of wrongful death after shooting an armed man. According to the suit, Deputy Alan Morrical already had Chad Thomson cornered by a police dog which bit him. But Judge Ted Stewart threw out the suit, ruling that Morrical's use of deadly force was justified as he acted in self defense. The judge also refused to accept any argument that officers made the situation worse by not calling off the dog when Thomson asked them too. He said, "Officers need not acquiesce to an armed and threatening suspect's demands when they are attempting to apprehend him." The lawsuit, filed by Thomson's widow, had asked for at least $4 million in damages.
