Employer Liable for Harassment by Non-Employee

The California Supreme Court confirmed that a recent amendment to the Fair Employment and Housing Act simply clarified and did not change existing law. The amendment reinforced that an employer may be liable for failing to protects its employees from sexual harassment by a non-employee. The Court held that this law may be applied to actions that arose before the amendment became effective.Â
