Court Upholds Wrongful Death Award

An award of $13 million has been upheld in a Delaware court for the family of a patient who died at a nursing home. June Bailey died of injuries sustained at the Lewes Convalescent Center Inc. The 60-year-old trapped herself in a freezer with four hours, suffering frostbite and dying a few weeks later as a result. According to attorneys for the Lewes Convalescent Center Inc., the judge had made mistakes during the trial. But the court upheld the original damages award of $13 million. Beebe Medical Center, who own the Lewes Convalescent Center Inc., said, "We publicly took full responsibility for her death and privately we settled the punitive damages claim with the family in the amount of $5 million."
